A three judge panel of the Court of Session coming down with the ruling.
The government appealing the decision to the Supreme Court in London.

Meanwhile a report released claiming disastrous consequences if the "No Deal" Brexit advocated by Nigel Farage goes through.
The trend of the Brexit issue at this point appears to be the Boris Johnson Government creating high drama and high controversy ahead of a deal similar to or maybe exactly like the one Theresa May cut with the European Union before she resigned is in the works, what opponents call a "Fake Brexit"
Foreign students will be allowed to stay in the United Kingdom for two years after they finish their studies to look for a job.
Prime Minister Boris Johnson said the change would allow students to "unlock their potential" in the UK.
In 2012 a rule was adopted limiting foreign students to a four month stay after they completed their studies.
The US Supreme Court allowing President Trump's rule on immigrants seeking asylum to remain intact while the matter is hashed out in the court system.
Seven of the nine justices with the exceptions of Sotomayor and Ginsburg agreeing that the rule excluding those who did not seek asylum in third countries they passed through on the way to the United States from seeking asylum can remain.
The ruling only applies to the time period pending the outcome of legal challenges to the rule.
President Trump announcing a two week delay in a 5 percent tariff hike on 250 billion dollars in Chinese goods set for October 1st.
The President calling a "gesture of good will" requested by China after the Chinese government scrapped some planned tariffs on US goods.
Both countries planning to meet for new talks on resolving differences over trade.
Today is the 18th anniversary of the Al Qaeda jihadist attacks on the United States, inspired by the Wahabbi Muslim ideology of Saudi Arabia and carried out by 19 attackers, 15 of whom were Saudi citizens. Some were aviation students in the United States.
On the eve of the anniversary of 9/11 Turkish media were given intelligence audio transcripts from the Saudi Consulate in Istanbul. The transcripts of what was said before, during and after the killing of Saudi journalist Jamal Khashoggi.
"Is it possible to put the body in a bag?"

The last part of the transcript notes the sound of a bone saw being heard.

Russian airstrikes in northwestern Syria early this morning against jihadist opposition targets.
The Russians has refrained from airstrikes since a cease-fire they declared in the region came into force Saturday August 31st. But the opposition has staged repeated violations.
And a few hours after the Russian cease-fire was declared on the Labor Day Weekend, a US attack in the cease-fire area that killed 40 Al-Qaeda leaders.
The attack surprising because the United States has supported the claims of the jihadist opposition of chemical attacks and other atrocities by the Syrian government.
Also United States political leaders including the late Senator John McCain and current Senator Lindsey Graham in the last year have met jihadist opposition leaders to offer sympathy and support.
Another post 9/11 aspect of US government policy domestically was the defining of Americans as terrorists like the Bundy Family in conjunction with the Bunkerville and Oregon Standoff cases.
A federal judge ruled last week that the terrorist watch list violates rights and wants to hear arguments on its merits

The election campaign in Canada kicking off today with Prime Minister Justin Trudeau asking Canada's Governor General for dissolution of Parliament.
That will set the stage for scheduled election on Monday October 21st with Trudeau seeking re-election after his 2015 election win.
Tuesday night results from the provincial election in Manitoba, Canada resulted in another majority government for the Progressive Conservative Party of Premier Brian Pallister.
His policies of tax cuts and cost cutting said to have driven voters in the election. The PC's winning 36 of the 57 seats in the provincial legislature.
The Venezuelan military conducting drills in the border regions with Colombia after regime ruler Nicolas Maduro put the military on alert last week over an alleged invasion threat.
It is being claimed that some 150-thousand troops are participating.
NFL star Antonio Brown being accused of sexual assault and rape in a civil lawsuit filed in federal court in Florida Tuesday.
Britney Taylor, who says she met Brown through the Fellowship of Christian Athletes, alleges that she was sexually assaulted by Brown twice in June of 2017 and that he forcibly raped her in May of 2018.
An attorney for Brown denies the allegations and promises a countersuit with Brown describing the suit as a "money grab".
Brown had signed with the New England Patriots in recent days after a dispute with his former team the Oakland Raiders.

Late Tuesday night the Patriots issued a statement that the NFL is investigating the matter and that the allegations are taken very seriously. For now no further comment.
French police seeking witnesses in their investigation of Jeffrey Epstein with three alleged victims set to testify.
Epstein owned an apartment in Paris and there is an allegation that he was involved in sexual activity with three 12-year old girls there.
