BUNKERVILLE STANDOFF: OTHER THREE DEFENDANTS ARE ORDERED RELEASED FROM JAIL, TWO WILL BE FREED, CLIVEN BUNDY DECIDES TO STAY
It was a surprise move in and of itself when US District Judge Gloria Navarro reversed herself on November 13th (one day before the trial began) and released Ryan Bundy from jail.
But now word that Judge Navarro is releasing the other defendants Cliven Bundy, Ammon Bundy and Ryan Payne to home detention as well.
CLIVEN BUNDY DECIDED TO STAY IN JAIL UNTIL OTHER PRISONERS CURRENTLY HELD FOR A LATER TRIAL ARE RELEASED. HIS ATTORNEY BRET WHIPPLE NOTED THAT BUNDY IS A 'PRINCIPLED MAN'.
AMMON BUNDY WILL BE RELEASED IN THE MORNING AND RYAN PAYNE WILL BE RELEASED LATER.
JUDGE NAVARRO IS SENDING THE CONDITIONS OF PAYNE'S RELEASE TO THE JUDGE PRESIDING OVER THE OREGON STANDOFF CASE, US DISTRICT JUDGE ANNA J. BROWN IN PORTLAND.
RYAN PAYNE HAS ENTERED A GUILTY PLEA IN CONNECTION WITH THE OREGON STANDOFF PROTEST WHILE AMMON AND RYAN BUNDY, ALONG WITH FIVE OTHER 'LEADERS' OF THE PROTEST WERE FOUND NOT GUILTY BY A JURY AT THEIR TRIAL.
WHILE THE HEARING THAT LED TO JUDGE NAVARRO'S ORDER TO RELEASE THE DEFENDANTS TO HOME DETENTION WAS CLOSED TO THE PUBLIC, THOSE INSIDE THE ROOM PASSED A SENSE OF THE HEARING TO THE OUTSIDE WORLD.
TRIAL OBSERVER JOHN LAMB POSTED A VIDEO SAYING THAT THE JUDGE 'SCOLDED' THE PROSECUTORS OVER THEIR WITHHOLDING OF EVIDENCE FROM THE DEFENSE.
EVEN WITH HER BIASES, JUDGE NAVARRO IS SEEING TOO MUCH WEAKNESS IN THE FEDERAL GOVERNMENT'S CASE TO JUSTIFY CONTINUED IMPRISONMENT OF THE ACCUSED.
Cliven and Ammon Bundy have been consistently wearing their jail clothing to court and perhaps that helped Judge Navarro make her decision to help influence the jury away from sympathy for the defendants.
Having the jury submit written questions for witnesses has helped her see how they feel about the case plus she herself has seen how the federal prosecutors have withheld information from the defense in this case during this trial. Don't really know if that is also playing a role in her thinking.
Supporter Brand Thornton posted a video during the day noting that he and other supporters were waiting outside the courthouse for the men to be released and the atmosphere is very happy with optimism about other defendants still in jail awaiting trial also being released at some point.
The release decision came amid a closed door hearing on matters related to the case involving the prosecution, defense, and Judge Navarro.
Brand Thornton on video from outside the courthouse also mentioned the presence of judicial activist Larry Klayman who's filed a lawsuit related to the case.
The trial continued later in the day with Judge Navarro allowing Ryan Bundy, acting in his own defense, to wear a cowboy hat during questioning of a witness.
The trial is over for this week and will not be happening next week, but will resume on December 11th.
While it would be wrong to reach any sweeping conclusion about where the trial is going, it is safe to say that the prosecution in the case led by a man praised for his "leadership" by Attorney General Jeff Sessions in July during a Las Vegas visit (Acting US Attorney Steven Myhre) is watching the case he is making against the defendants in a sharp downward trajectory.
