Today in Las Vegas, a Democrat judge (US District Judge Gloria Navarro), a protege of the former Democrat Senate leader Harry Reid, will rule on whether the mistrial involving 15 felony charges each for four men (Cliven Bundy, Ammon Bundy, Ryan Bundy and Ryan Payne) will be dismissed "with prejudice" or "without prejudice".
With prejudice ends the charges, but without prejudice would mean a new trial on February 26th.
Then the lead prosecutor Steven Myhre, a Republican praised by Republican Attorney General Jeff Sessions for his "leadership" in the case, backed by an expert in discovery evidence sent by Republcian Sessions and a new Republican US Attorney for Nevada designated by Sessions will have to decide on their response.
The case has reached this juncture after three trials involving the limiting of witnesses for the defense and the censorship of defense lawyers and defense witnesses, including a defendant testifying in his own defense. It was all demanded by the Republican-led prosecution and agreed to by the Democrat judge.
What broke the logjam in this case was the release of more than three thousand pages of "discovery evidence" withheld by prosecutors from the defense.
What forced that was what you might call either an "act of God" or "sheer luck" on December 3rd during the third trial when defendant Ryan Bundy, acting in his own defense. got a prosecution witness under cross examination to admit the existence of an FBI surveillance camera in the days leading up to the April 12, 2014 standoff near Bundy Ranch.
This aroused the suspicion of Judge Navarro, who started to pressure the prosecution to turn over any and all information about cameras and snipers around the ranch, kept hidden by the prosecutors.
After 3300 pages of withheld discovery evidence was turned over to defense lawyers, Judge Navarro ruled a mistrial on December 20th citing at least six instances of "willful" (deliberate) withholding of evidence by the prosecution.
